1. Acceptance of Terms

By accessing or using Moodboard, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the service.

2. Description of Service

Moodboard is a visual organization tool that allows you to create, organize, and share mood boards with images, text, drawings, and other visual elements. The service includes:

  • Creating and managing visual boards
  • Uploading and organizing images
  • Adding text, sticky notes, and freehand drawings
  • Sharing boards publicly via links
  • Exporting boards as images or data files

3. Account Registration

To use Moodboard, you must:

  • Create an account with accurate information
  • Be at least 13 years old
  • Keep your account credentials secure
  • Notify us of any unauthorized access

You are responsible for all activity under your account. We reserve the right to suspend or terminate accounts that violate these terms.

4. User Content

Your Ownership

You retain ownership of all content you create or upload to Moodboard ("User Content"). We do not claim any ownership rights over your content.

License to Us

By uploading content, you grant us a limited license to store, display, and process your content solely to provide the service. This license ends when you delete your content or account.

Your Responsibilities

You agree that your User Content will not:

  • Infringe on intellectual property rights of others
  • Contain illegal, harmful, or offensive material
  • Include malware or malicious code
  • Violate any applicable laws or regulations

5. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Upload content that infringes copyrights or trademarks
  • Attempt to access other users' accounts or data
  • Interfere with or disrupt the service
  • Use automated tools to scrape or access the service
  • Circumvent any security measures
  • Resell or redistribute the service without permission

6. Intellectual Property

The Moodboard service, including its design, code, features, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the service without our written permission.

7. Public Boards and Sharing

When you make a board public, anyone with the link can view it. You are responsible for ensuring you have the right to share any content in public boards. Public boards may be indexed by search engines.

8. Service Availability

We strive to keep Moodboard available and reliable, but we do not guarantee:

  • Uninterrupted access to the service
  • That the service will be error-free
  • That data will never be lost (please keep backups of important content)

We may modify, suspend, or discontinue aspects of the service with reasonable notice when possible.

9. Free and Premium Plans

Moodboard offers a free plan with core features. Premium plans (when available) will include additional features and higher limits. We reserve the right to change pricing and features with notice.

10. Data and Backups

While we implement reasonable measures to protect your data, you are responsible for maintaining backups of your important content. We recommend regularly exporting your boards.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The service is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid us in the past 12 months (if any)

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these terms.

13. Termination

You may delete your account at any time through Settings. We may suspend or terminate your access if you violate these terms. Upon termination:

  • Your right to use the service ends immediately
  • We may delete your data after a reasonable period
  • Provisions that should survive termination will remain in effect

14. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance of the new terms.

15. Governing Law

These terms are governed by applicable law. Any disputes will be resolved through good-faith negotiation first, then through appropriate legal channels if necessary.
